ICE SKATING WAIVER & RELEASE OF LIABILITY

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT.

By completing and submitting this digital form, you ("Participant" or "Parent/Guardian") acknowledge, understand, and agree to the following terms and conditions related to participating in ice skating activities operated by The Big Wish Ltd at Newcastle Winter Wonderland.

1. Assumption of Inherent Risks

I understand that ice skating on a real outdoor ice rink involves inherent and unavoidable risks, including but not limited to:

Slips, trips, and falls

Collisions with other skaters, equipment, or rink structures

Variations in ice surface conditions due to weather

Exposure to cold or changing weather conditions

Equipment malfunction or failure

Personal injury including bruises, sprains, fractures, head injuries, or in extreme cases disability or death

I voluntarily assume full responsibility for these and any other associated risks.

2. Release of Liability & Waiver of Claims

To the maximum extent permitted by law, I hereby release, waive, discharge, and hold harmless:

The Big Wish Ltd, its owners, directors, officers, employees, contractors, agents, volunteers, and affiliates

from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to:

Personal injury

Property damage

Illness (including cold-related conditions)

Accidents or incidents occurring on or near the ice rink

Participation in any ice skating or ice-related activities

This waiver applies even if the injury or damage is caused by negligence (but not gross negligence or willful misconduct) of The Big Wish Ltd or event staff.

3. Indemnification

I agree to indemnify and hold harmless The Big Wish Ltd from any claims brought by third parties arising from:

My actions or conduct

My violation of rules

My participation in the activity

This includes legal fees and related costs.

4. Safety Rules & Participant Responsibility

I agree to follow all posted rules, safety notices, and instructions from event staff, including but not limited to:

Wearing appropriate clothing and rented or approved skates

Skating in the correct direction and maintaining control at all times

Not engaging in reckless or dangerous behavior

Exiting the ice immediately if instructed by staff

Reporting hazardous conditions promptly

Failure to follow safety rules may result in removal without refund.

5. Fitness to Participate

I confirm that:

I am physically and mentally able to participate safely

I do not have medical conditions that could increase my risk of harm

I am not under the influence of alcohol, drugs, or substances that impair judgment

6. Medical Treatment Consent

In the event of an injury or emergency, I grant permission for The Big Wish Ltd staff or medical professionals to administer first-aid or obtain emergency medical care.

I accept full financial responsibility for any associated medical treatment.

7. Personal Property

I acknowledge that The Big Wish Ltd is not responsible for loss, theft, or damage to personal belongings.

8. Media & Photography Consent (Optional)

I grant permission for The Big Wish Ltd to use photographs or video taken at the ice rink for promotional or marketing purposes.

If signing for a minor, I certify that:

I am the child's legal parent/guardian

I consent to the minor's participation

I agree to all terms on the minor's behalf

I understand that this waiver applies equally to the minor.

This agreement is governed by the laws of England and Wales.

Any disputes shall be resolved under these laws.
